There are times when you are on ezCater Orders where events take place that cause significant delays and how those restaurants choose to respond to those delays are what makes the difference between a quality team and a shitty one.
In this case, I have experienced this team and its horrendous business practices and discovered some questionable things that I feel should be explored a bit more from a gig workers perspective and a business owners perspective.

I also want to be clear I am speaking from my own experience and what my experience may be, may not reflect yours.
The Order Itself
So I received an order on ezCater that had a $35 payout and the order traversed less than a mile away. Should have been an easy in and out order with a minor challenge with getting to the drop off location too early.
There is one other hiccup for this location as well… parking, or lack thereof.
Now they are usually lenient on those who are just picking up something but you can’t stick around and because this location is very close to a courthouse, there are Sheriffs, Police Officers and Parking Enforcement everywhere.
So I run in and try to get someone's attention and they just keep ignoring me, they acknowledge that I am there, they make eye-contact, and they choose to ignore me.

You can’t be in a location that has no parking, have gig workers consistently come in and out of the location and choose to act in ignorance.
The owner acknowledges me after I am examining one of the orders that is on the shelf, turns out that isn’t the order I need to pick up either, and they didn’t even start it. It is already late for pick-up and they didn’t even start it.
Oh man, I can’t believe that happened. I didn’t even get notified or saw it come in…
I say that jokingly, but there is no sense of remorse or empathy in the failure and the gross negligence that is their actions. They claim it is going to be 10 minutes to whip it up, they took 25, because they are failures.
I have to keep an eye on my car through the window and report to my dispatcher so he can complain and get more money out of them, I asked them again how long it is going to be for my dispatcher to know but they kept ignoring me.
After asking 5 times someone said a few minutes.
I get the food they handed me packed in my catering bags, ask them if that is everything… ignored again. At this point, I am pissed and I just walk out.
I throw everything in the car, the manager walks up to the window of my car and knocks on it, it wasn’t everything there was one more platter left.
I ask if that is everything again, he YELLS inside the place asking if that is everything twice, looks back at me through ajar door and just nods… communication at its finest.

Now usually, I chalk this up to discrimination against gig workers and call it a day, but it turns out it is much more than that.
I go onto Yelp to make my usual review on the poor integrity and character of the organization and I am not the only one to leave one star reviews based on service.

You would think that for those reviews, they would ask for your email and offer to remedy the situation since that is how they did things in the past. Nope, some of them had really screwed up responses.

One person made a comment about not receiving their change back and he said it made as much sense as showering with your clothes on… just wow. You justify theft with insults now?
I also make sure whenever I end up having an issue with an order like this, I make a Yelp Review going over everything that took place and people I dealt with so the owner can go over this and make the changes accordingly.
After all, they earned the review, why shouldn’t they be held accountable for their actions?

Honestly, after looking through their reviews even further it seems like this is just normal for them. Piss poor service, by piss poor people, who operate with piss poor integrity an character.
It seems like censoring reviews and slandering customers, while also treating people like garbage is just another day. Always claiming to talk to people when in reality, they never actually fix the reoccurring problem.
Most likely due to the core problem being the owner themselves, Louis Migliaccio, condoning the behavior behind closed doors, and silencing people who have opposing opinions.

I also make sure I file a report with ezCater as well as my dispatcher so I can make sure that I get the late fee for the time I committed to the order.
That said, usually these incidents are met with one of two things. First being a change of attitude and a sense of accountability for the behaviors that took place. The second is when they double down on the behaviors that they have already done.
That’s a Wrap Sandwich Co. Harrasses Me
In the Yelp Review, the review managed to piss off the owner of the company for sure, but that has been expected based on how his other reviews have earned a response in an abusive tone.

Joey, a quick glance at your Yelp reviews, it seems the problem is YOU. I encourage everyone to take a look at this delivery drivers reviews on his page and make the call yourself. I am also speaking with the company he works for, RMDA, to have him removed permanently from doing deliveries. Businesses deserve better.
I get that patterns do seem that way at times, but only if you look at the surface. Because if I have 20k deliveries completed and only a few Yelp Reviews, that means you are the problem.
In case you guys don’t know, the RMDA is the Restaurants Marketing Delivery Association, the national professional trade association for local and regional delivery companies serving the hospitality industry, and clearly this guy doesn’t ACTUALLY know how the system works.
We are independent contractors and the RMDA sends these orders through to ezCater and the MOST he can do is have me banned from picking up his orders, and quite honestly… good. I don’t want to work with someone like him either, especially not after what happened next.
He is also messaging me privately.

Joseph Mandracchia, you are a delivery driver for RMDA. You knew the order did not appear in the app as you were standing right next to us. I have notified EZ Cater and waiting on a call back from RMDA. Your behavior is unacceptable.
Trying to reprimand me like I am a child or an employee of his, I had to remind him on how the system ACTUALLY works, because some of these restaurants think they are the end all be all.

Louis Migliaccio, you are the president of that's a wrap sandwich co. Your employees knew it was in the system and much like your failure customer service practices, you chose to ignore it and we have confirmation of that. You were reported to EZCater long before this and I will make sure no one does business with you again for treating me the way you have.
By the way thanks for the information, now that I know for a fact that a failure like you doesn't have the slightest idea of how this works, I'll be sure to add that to all following reports as well as this level of harassment.
May not have been the most effective way to handle this, but I call it as I see it, and anyone who chooses to spin the story to where they have no sense of accountability and harassing drivers when they screw up is a failure.
Still, people like him have a tendency to spin the truth in a negative light on others and take no accountability for their piss poor behavior. So I decided to follow up with some people.
Getting Ahead of It
First of all, I had already reported that the order was late so I can get paid the late fee, but I am certainly not going to let someone choose to slander my character without recourse.
So I decided to get in contact with my Dispatcher at the time with FoodFetched as well as make my own report to ezCater. I can’t let someone lie about me and attack my income.
They clarified that a report has been made and the most they can do is report to ezCater and have me banned from their store… again not a big deal.
Things Escalated
Louis is definitely the guy who will instigate a fight and then act all surprised when they clapback, as is displayed in his private messaging and his attempts at slandering me publicly.

Louis: Joey. you have already been banned from ever taking a delivery and I am working my way up the chain. Failure like me? no comment. I am always available for a chat.
Me: Louis, you don't have that authority and the only thing you did was bury yourself by continuing to harass me.
Louis: I can assure you nobody is scared of your threatening tactics. Again, I wish you well on your driving journey. I am always here to assist in any way you need!!
Me: Spoken like the condescending failure threatening my income, let's see how you handle it.

Isn’t it cute when someone harasses you and they have no idea how the system works, only to invite more problems into your business?
I had a cousin who did this a lot. They picked a fight, lost the fight, and then cried when they lost, and of course parents having no sense of pattern recognition only reinforced the behavior by blaming everyone else but their children and their own parenting.
At least in my cousin's case, the information provided was accurate… they omitted the parts where they picked a fight, but it is true, they lost in a fight and they had the evidence to back it up.
In this guy's case, all he did was pick a fight with limited information because he is having a hissy-fit choosing not to understand how the business ACTUALLY works, and cried when I did have the evidence, and resorted to slandering me in the process.

Louis: Joey, you are un-hinged. Take care of yourself. EZ-Cater has been notified of your racist, threatening messages (copies have been sent) have been reported to them as well as RMDA. Good luck.
Unhinged? Maybe.
Threatening? Only if it is true, which it is and documentation has been provided.
But Racist? Never happened.
Look, I get that some people feel as if they have been discriminated against, even in situations of undertones and unspoken language, I can see how people might feel that way. I certainly do when restaurants treat gig workers with disrespect because they are delivering their order.
Which is why I can say, nothing I did was out of ANY kind of discrimination, it is basic human decency! Amazing how people can misunderstand basic respect principles for an attack on them personally.
Needless to say, this had nothing to do with race and that being posted publicly is just slander and evidence for me for a defamation of character case.

Louis: Condescending, like calling people a failure, clueless, harassment, horrendous people, ignorant, I can keep going? I will pray for you. Please do not threaten me, that is extremely unprofessional as is everything else you have said. You are making indirect threats toward me and giving me no choice to make a police report. I have a report number for EZ cater as well, they are on it. Thinking about all of this, we should start over. Unfortunately, the order wasn't showing up on app until the actual order number was entered, as you are aware since you were standing there. They went as fast as they could, my apologies it was not ready for you to pick up and deliver as that is not the norm for us. Either way, we wish you well and hope that your deliveries go smooth for you. Sometimes things happen on both ends but as adults we do the best we can. It seems to happen alot for you. There is a lot to unpack with this message. First off, you can say those first few are me because I did point out those qualities in your messaging.

You were condescending and it showed through the tones of your message.
You failed to meet the expectations that you committed to and threw a hissy fit and picked a fight when you didn’t, as displayed for a couple of your responses. Characteristics of a failure.
You didn’t have a clue on how the system worked which was displayed by your own messages.
You are literally harassing me by messaging me over and over again, and inviting more engagement, which is your piss poor choices on display.
All of which is a display of how much of a horrendous person you are, I can’t speak for your people that much because they only showed me their piss poor customer service skills.
Choosing not to acknowledge your own mistakes and harass others is an ignorant thing to do, so all of which is factually accurate!
Second, if you were concerned about professionalism, you would have done your job or accepted the criticism while learning and growing from your mistakes, so don’t ask for professionalism if you choose not to be professional yourself.
Third, what are you going to tell the police?
This man on the internet is exposing me for the person I truly am! Arrest him officer!
All I heard was I now have the means for a defamation case, that includes the ezCater report!
The most legendary part about this wasn’t even that, but in THE SAME MESSAGE of threatening me, my business and my brand, he backpedals SO HARD, that I can feel the outside party intervening!
I don’t know if it was ezCater, or if it was my dispatcher, someone from his side of things or what, but MAN did this guy REALLY change his tone out of nowhere! Not to mention the inspirational speech after that, making it sound like he is making a difference by reaming people out.
Still got that condescending tone though, with the whole “adults” point he was making. Either way, I have no plans for going back but it sure would be a waste of that free meal so feel free to take him up on it. Tell him your ezCater driver sent you.
Moving Forward
Obviously, I am not going back there but this went really well and could have been a whole lot worse. In too many cases, if a report like that came in to Doordash UberEats or Grubhub, they would have no problem deactivating me for this, even though I am 100% in the right.
I am going to have to edit the review I made earlier on this subject and make sure that I address a lot of the slander that has taken place, so I can make sure I am protecting myself in a legal capacity.
Overall though, I don’t know if I would have the confidence to defend myself like this if I didn’t already have a well diversified gig portfolio, then I would be more concerned about my position.
That said, I have plenty of avenues of income as well as an exit strategy in place. The gig economy is an income bridge to what would be a long term goal for me, not the goal. Obviously for good reasons, I mean just look at what happened?!
